Victims and Survivors (Disqualification) Bill (NIA Bill 6/10)[AS INTRODUCED] CONTENTS Interpretation: “victim and survivor” A B I L LTO Narrow the classes of persons who may benefit from provisions in the Victims and Survivors ( Northern Ireland) Order 2006. BE IT ENACTED by being passed by the Northern Ireland Assembly and assented to by Her Majesty as follows: Interpretation: “victim and survivor”1.-(1) The Victims and Survivors ( Northern Ireland) Order 2006 (NI 17) is amended in accordance with subsections (2) to (4). (2) At the end of Article 3(1)(a) of that Order insert - “provided that individual has not been convicted of— (i) an offence in connection with any conflict-related incident; or (ii) being a member of a proscribed organisation.”. (3) For Article 3(1)(b) of that Order substitute - “someone who provides a substantial amount of care on a regular basis for an individual who has been physically or psychologically injured as a result of or in consequence of a conflict-related incident;”. (4) At the appropriate place in Article 2(2) insert - ““proscribed organisation” means an organisation for the time being specified in Schedule 2 to the Terrorism Act 2000 (c. 11) and includes an organisation which is treated as a proscribed organisation by virtue of Section 3(6) of that Act provided any organisation so specified or treated as proscribed is connected with the affairs of Northern Ireland.”. Commencement2.This Act comes into operation on Royal Assent. Short title3.This Act may be cited as the Victims and Survivors (Disqualification) Act ( Northern Ireland) 2010. |
