‘ Duty of ESA in relation to appointment of Boards of Governors of Irish speaking schools
34A. It is the duty of ESA, to appoint persons to a Board of Governors of a school designated as an Irish speaking school or to a school in which part of the school is designated as an Irish speaking school, and, in appointing such persons, that ESA is required to choose for appointment persons appearing to ESA to be committed to the continuing provision of Irish-medium education in the school.’

After clause 49 insert -
‘Irish speaking schools
49A. - (1 ) For the purposes of the Education Orders, an Irish speaking school is a school or part of a school which is for the time being designated in a scheme under this section.
(2) The Department shall, after consultation with the relevant Irish speaking organisations , make a scheme designating those schools which are to be Irish speaking schools for the purposes of the Education Orders.
(3) The Department -
(a) may make such other amendments to that scheme as appear to it to be necessary or desirable.
(4) For the purposes of the Education Orders a school becomes an Irish speaking school on the date on which it is first included in the scheme under this section.
(5) For the purposes of this section “the relevant Irish speaking organisations” are -
(a) any body funded by the Department of Education under Article 89 of the 1998 Order; and
(b) the sectoral support body for Irish speaking education.’
