The Chairman called the meeting to order at 10.05 and declared the meeting open to the public.

He welcomed visitors from Sweden to the public seating area.

1. Minutes of Proceedings on 12 January 2001

1.1 Resolved: that the draft Minutes of Proceedings for 12 January 2001 were approved.

2. Matters Arising

2.1 The Members discussed the Press Release issued by the Deputy Chairman on behalf of the Committee following the Minister's announcement on her decision regarding the detailed rules for allocating the additional milk quota in Northern Ireland. Messrs Dallat, McHugh and Ford expressed concern that the press release had not conveyed the views of all members.

2.2 Members discussed the itinerary for their forthcoming visit to Enniskillen College on Wednesday, 31 January 2001.

Messrs Bradley and Dallat wished it to be noted that they were unable to attend due to other pre-arranged Assembly business.

2.3 The Committee discussed its Forward Work Programme and resolved to invite the Minister to meet the Committee on Friday, 23 February to discuss rural proofing, proposals for beef quality and an update on Fisheries issues.

2.4 Members noted a copy of the letter confirming the appointment of Mr Frank Ferguson as Specialist Adviser to assist with the Committee's consideration of the Animal Waste Directive and EC Proposals concerning TSE Regulations.

2.5 Committee staff advised the Committee that the Clerk Assistant hoped to be able to provide general guidance to committees regarding advice during hearings.

2.6 The Chairman signed the following letters to be issued on behalf of the Committee: a response to correspondence from Mrs Gill, Dungannon and Armagh Health Action Zone, regarding Counselling for farmers (a copy to be sent to the Minister) and a letter to the Minister regarding the disparity in beef prices between Northern Ireland and Scotland.

2.7 The Committee deliberated on the disclosure that spinal cord has been found in two consignments of beef imported from Germany.

Resolved: that the Committee should hold a special meeting on Monday, 22 January to discuss this matter with the Food Standards Agency, DARD and the Livestock and Meat Commission.

3. Statutory Rules:

3.1 Members noted the proposed Statutory Rules which had been considered and approved by the Health, Social Services and Public Safety Committee:
1. Restriction on Pithing Regulations (NI) 2000
2. Fresh Meat (Beef Controls) Amendment) NI 2000
3. Specified Risk Material (Amendment No 2) regulations (NI) 2000
4. Miscellaneous Food Additives (Amendment) Regulations (NI) 2000

4. Statutory Rules - Pre- drafting Consultation

4.1 Lobster (Conservation of Stocks) (Revocation) Regulations (Northern Ireland) 2000 - Pre-drafting Consultation

Agreed: that the Committee was content for the Department to proceed with making the proposed Rule.

4.2 Welfare of Animals (Fees) Order 2001 - Pre-drafting Consultation

Agreed: that the Committee would wait for the result of the Department's consultation on the proposed Rule before giving their opinion.

4.3 Organic Farming Regulations (NI) 2001 - Pre-drafting Consultation

4.3.1 The Committee welcomed Mr Liam McKibben (Grade 5, DARD), Chair of the Organic Farming Liaison Group, Mr Ian McKee, Head of Crops and Environmental Policy Division (DARD) and Dr Sam Kennedy, Head of Crops and Horticulture at Greenmount to the meeting at 11.00 am.

4.3.2 Mr McKibben made a short statement on the Rule which revoked and replaced previous EU legislation that expired on 31 December 1999 and provided for the payment of aid to farmers in order to bring the Organic Farming Scheme into effect. The proposed new legislation introduced an arbitration procedure, which improved the farmers' right to appeal.

4.3.3 Mr McKibben then answered questions put to him by the Committee.

4.3.4 The Members were informed that, although only 4 out 8 responses were received in reply to the Consultation letter, the proposals were widely accepted within the industry.

4.3.5 Resolved: that the Committee was content for DARD to proceed with the proposed legislation but members would continue to press for the following:

  • that support will continue to be provided to farmers undertaking the switch to organic farming for a number of years
  • that specialist assistance will be given, particularly with regard to marketing strategy/business planning
  • that training and assistance in terms of technical/science issues will be provided

5. Organic Farming

5.1 DARD Officials remained at the meeting to discuss further the implications of Organic Farming as an opportunity for Northern Ireland Farmers.

5.2 There followed a question and answer session and a number of issues were raised including:

  • The need for a reasonable period of familiarisation with the Code of Good Farming Practice - it should not be so restrictive as to put off farmers entering organic farming.
  • Ensure organic farming activities do not have an adverse effect on the farming industry in general
  • Appointments to the Organic Farm Liaison Group
  • Long term opportunities for small Northern Ireland farmers as niche market exporters
  • Need for a long term strategy to assist farmers after the initial 5 year aid is reached

5.3 Agreed: to meet with the consultants, who are carrying out the study into organic farming, during the meeting to be held on 26 February in order to establish the stage reached by the consultants, issues which have been raised and to offer opinions to the consultants.

6. Restrictive Licensing of Shellfish

6.1 Members considered a consultation paper to be issued by Fisheries Department in the UK.

6.2 Resolved: that the Committee could await a report from DARD once consultation was complete but in the meantime seek the views of the fish producers organisations.

7. Nephrops Quota

7.1 The Committee considered a fax from Alan McCulla on the EU nephrops quotas declaration and the decommissioning scheme.

Resolved: that the Chairman should write to the Minister, seeking an urgent written update on the two issued and putting these two items on the Agenda for the proposed meeting on 23 February.

The Chairman closed the meeting to the public at 12 noon.

8. Committee Inquiry into Debt - The Particular Circumstances Faced by the Pig Industry - Consideration of the Pigs Report

8.1 The Committee considered a letter dated 8 December 2000 from the National Pig Association which referred to the UK-wide Pig Industry Re-structuring Scheme. The letter sought assistance from the Committee Chairman in "making a success of the scheme.

8.2 Resolved: that the Committee should refer to the Scheme in its Report and suggest that producers give it careful consideration. However, the Committee could not fully endorse the Scheme without being certain of what was on offer to producers. The Committee would, in the Report, ask the Department to ensure producers were in the position to make sound judgements about what the Scheme offered.

8.3 The second draft report, incorporating additional paragraphs as ordered by members at their meeting on 23 November 2000, was brought up and read, paragraph by paragraph.

  • Malton Bacon Factory Ltd.;
  • Ulster Farmers' Union;
  • Ulster Pork and Bacon Forum;
  • Northern Ireland Agricultural Producers' Association;
  • United Pig Producers' Co-operative;
  • Ulster Curers' Association; and
  • Department of Agriculture and Rural Development.

8.12 Resolved: that a launch date for the Report be agreed between the Chairman and Deputy Chairman.

9. Date of next meeting

9.1 Resolved: that the next meeting of the Committee would be a special meeting on Monday, 22 January 2001, together with a regular Committee meeting on Friday, 26 January 2001 at 10.00
