Terms of reference

  1. I make this report to the Secretary of State for Northern Ireland under the authority of directions given by the Secretary of State on 13 November 2002 to continue the technical scrutiny during the suspension of the Northern Ireland Assembly under the Northern Ireland Act 2000 (which took effect from 15 October 2002) and to report to the Secretary of State from time to time. My terms of reference expressly refer to statutory rules subject to negative resolution or confirmatory procedure; statutory rules subject to affirmative resolution and statutory rules subject to approval in draft by a resolution of the Assembly are in effect translated by the provisions of the 2000 Act into statutory rules subject to annulment in pursuance of a resolution of either House of Parliament (and as such come under the scrutiny of the Joint Committee on Statutory Instruments at Westminster).
  2. Technical scrutiny is a convenient shorthand expression intended to cover the matters set out in Assembly Standing Order 41(6) under which I operate when assisting the Assembly and its Committees in the scrutiny of statutory rules and draft rules laid before it. Standing Order 41(6) is in the following terms—

    “(6) In scrutinising an instrument the appropriate Committee [in practice the Examiner of Statutory Rules under delegations from the Committees under Standing Order 41(4)(b) — words added by the Examiner] shall inter alia consider the instrument with a view to determining and reporting on whether it requires to be drawn to the special attention of the Assembly on any of the following grounds, namely, that:

    (a) it imposes a charge on the public revenues or prescribes the amount of any such charge;

    (b) it contains provisions requiring any payment to be made to any Northern Ireland department or public body in respect of any approval, authorisation, licence or consent or of any service provided or to be provided by that department or body or prescribes the amount of any such payment;

    (c) the parent legislation excludes it from challenge in the courts;

    (d) it purports to have retrospective effect where the parent legislation confers no express authority so to provide;

    (e) there appears to have been an unjustifiable delay in the publication of it or in the laying of it before the Assembly;

    (f) there appears to be a doubt whether it is intra vires or it appears to make some unusual or unexpected use of the powers conferred by the parent legislation;

    (g) it calls for elucidation;

    (h) it appears to have defects in its drafting;

    or on any other ground which does not impinge on its merits or the policy behind it.”.

Statutory rules covered by this report

  1. This report covers statutory rules laid before the Assembly between January 2005 and September 2005 (while the Assembly remains suspended).

The “twenty-one day rule” and related matters

  1. I have adopted the same approach to the twenty-one day rule as I adopted in my Third Report during suspension. I said there:

    “I do not draw attention in this report to any individual statutory rules on the ground that they have breached the so-called “ 21-day rule” (that is to say, the rule of practice applied to statutory rules subject to negative resolution whereby the rule-making authority should allow at least 21 days between the laying of a statutory rule and its coming into operation). I have taken the view that that rule is a rule of practice applied by active legislatures in their scrutiny of subordinate legislation and has little or no application during the prolonged suspension of the Assembly. Having said that, it is of course good practice for Departments to adhere the rule as far as possible: for one thing, the 21-day rule will again assume much greater significance when the Assembly is once more fully functioning. I regard this a temporary arrangement and will keep it under review.”.

Of course, I remind Departments that it is good practice to adhere to the “21-day rule”. In the period under review in this report I observe that several statutory rules were laid some time after they came into operation, plainly because of oversights: Departments need to strive to take care to avoid such oversights and to ensure, amongst other things, that officials responsible for the preparation of statutory rules receive any necessary training. On a slightly different (but related) note, I remind Departments that it is good practice to respond quickly to queries raised by the Examiner so that he can complete his scrutiny role on a statutory rule: again, this will assume much greater significance when the Assembly is restored.

General points to note

  1. Before drawing attention to particular statutory rules, I consider that it might be useful to mention several points in a general way. These points have come to my attention from time to time.

Electronic Communications Acts

  1. First, it is becoming increasingly common to define an “electronic communication” by reference to the meaning in either the Electronic Communications Act 2000 (passed by the Parliament of the United Kingdom) or the Electronic Communications Act (Northern Ireland) 2001 (passed by the Assembly). Both Acts contain identical definitions of “electronic communication”. But it seems to me plainly preferable that in a statutory rule made by a Northern Ireland department in respect of a transferred matter the reference should be to the Electronic Communications Act (Northern Ireland) 2001. See as an example the Dairy Produce Quotas Regulations (Northern Ireland) 2005 (S.R. 2005/70).

Offences committed by bodies corporate

  1. Second, I remind Departments that there are many provisions in the Interpretation Act (Northern Ireland) 1954 intended to shorten legislation. One such provision is section 20(2) on offences by bodies corporate. Departments can (and should) avail of this provision when making Regulations that deal with offences committed by bodies corporate. I commend to Departments the useful precedent in, for example, regulation 9 the Genetically Modified Organisms (Traceability and Labelling) Regulations (Northern Ireland) 2005 (S.R. 2005/271): that regulation applies section 20(2) in a modified form so that the provision is widened; it is not restricted to a body corporate the liability of whose members is limited (for example, a limited company); and it makes specific provision for a body corporate managed by its members.

Fees in respect of Community obligations

  1. Third, a Department making provision in subordinate legislation for the charging of fees should of course have power in primary legislation to do so, otherwise the provision containing the fee will be ultra vires: that is self-evident. Such a power may be found in particular “parent” legislation (for example, the Seeds Act (Northern Ireland) 1965 or the Road Traffic (Northern Ireland) Order 1995): if there is such a power covering provision for the fee in question, then plainly that should be used. But if there is no particular power, where a Department “in pursuance of any Community obligation, provides any services or facilities or issues any authorisation, certificate or other document”, then the Department should consider using the specific regulation-making power in respect of fees contained in section 56 of the Finance Act 1973, either on its own or in conjunction with section 2(2) of the European Communities Act 1972: in the case of a Northern Ireland department exercising functions in respect of a transferred matter, the consent of the Department of Finance and Personnel is required. The use of section 56 of the Finance Act 1973 in preference to section 2(2) of the European Communities Act 1972 has been raised by the Joint Committee on Statutory Instruments (see, for example, its Sixteenth Report in Session 2002 – 2003) and more recently by the Subordinate Legislation Committee of the Scottish Parliament (see its 11th Report on Subordinate Legislation in 2005). See as a recent example of Regulations made under section 56 of the Finance Act 1973 the European Public Limited-Liability Company (Fees) Regulations (Northern Ireland) 2004 (S.R. 2004/418); see also the Plant Health (Import Inspection Fees) Regulation (Northern Ireland) 2005 (S.R. 2005/373) and the Plant Health (Import Inspection Fees) (Wood and Bark) Regulations (Northern Ireland) 2005 (S.R. 2005/380).

Transfer of functions from justices of the peace to lay magistrates with effect from 1 April 2005

  1. Fourth, Departments should note that certain functions have been transferred from justices of the peace to lay magistrates with effect from 1 April 2005: see section 10 of and Schedule 4 to the Justice (Northern Ireland) Act 2002. So far as statutory rules made by Northern Ireland departments are concerned, this change is mostly likely to affect provisions where previously there would have been a reference to a sworn complaint in writing to a justice of the peace, say, seeking under a statutory power the issue of a warrant to enter premises for a particular purpose; generally, subject to the exceptions set out in Schedule 4 to the 2002 Act, the reference should now be to a complaint in writing to a lay magistrate. As an example to illustrate the change, see regulation 14 of the Detergents Regulations 2005 (S.I. 2005/2469).

Addressing the matter of the Convention rights

  1. And last (but by no means least) I mention to Departments that it would be good practice in appropriate cases to address the matter of the Convention rights in an accompanying memorandum: an example of an appropriate case would be regulations such as the Water Resources (Environmental Impact Assessment) Regulations (Northern Ireland) 2005 (S.R. 2005/32): see paragraphs 12 –14. It is likely that when the Assembly is restored its Committees will seek such information from Departments in relation some proposed statutory rules and statutory rules. I remind Departments also that it is in their interest to identify which, if any, of the Convention rights is (or are) engaged and proceed from there to outline the balancing exercise to show the justification for the provision in question or, expressed in another way, its compatibility with the Convention rights. Departments will be aware of the constraints of section 24 of the Northern Ireland Act 1998 in relation to subordinate legislation. Ultimately, of course, only a court can give a definitive judgment in a particular case, but clearly it is generally beneficial that the matter should be addressed at the stage when the statutory rule is being framed. I make the observation that the courts in Northern Ireland seem to be giving increasing emphasis to the need for a decision-maker making an administrative decision under a statutory regime to conduct a proper balancing exercise, first considering the question of the engagement of particular Convention rights and then proceeding to consider the justification for interfering with the particular Convention right (or rights) that are engaged: see, for example, the recent decision of the Court of Appeal (judgment of Kerr LCJ) in In the matter of an application by Misbehavin’ Limited for judicial review 2005 NICA 35. There may well be some distinctions between administrative decision-making and a provision in subordinate legislation. But clearly, if a Department making subordinate legislation has conducted a proper balancing exercise in the context of the Convention right (or rights) being interfered with when it is framing subordinate legislation, then it would seem that it would be in a better position to resist the subordinate legislation’s being impugned subsequently.

Statutory rules to which attention is drawn in this report

THE PLANT HEALTH (PHYTOPHTHERA RAMORUM) ORDER
(NORTHERN IRELAND) 2005 (S.R. 2005/23)

  1. I draw attention to the Plant Health (Phytophthera ramorum) Order (Northern Ireland) 2005 (S.R.2005/32) on the ground that it is defectively drafted similarly to the corresponding Order for England (S.I. 2004/2590): the Joint Committee on Statutory Instruments drew attention to the defects in its Thirty-Third Report in Session 2003 – 2004), namely, that the Order inadvertently failed to include any sanction for a breach of Articles 6(1) and (2) and 7(1) and (3) (which impose restrictions on the movement of certain material and, in the case of Article 7(3), a requirement). I raised the point with the Department of Agriculture and Rural Development in the light of the Joint Committee’s Report, and I am pleased to report that the Department has subsequently amended the Order accordingly: see the Plant Health (Phytophthera ramorum) (Amendment) Order (Northern Ireland) 2005 (S.R.2005/265).

WATER RESOURCES (ENVIRONMENTAL
IMPACT ASSESSMENT)
REGULATIONS (NORTHERN IRELAND) (S.R. 2005/32)

  1. I draw attention to the Water Resources (Environmental Impact Assessment) Regulations (Northern Ireland) 2005 (S.R. 2005/32) on the ground that the drafting of the provisions to which I refer below could be improved in certain respects, for greater consistency with other related statutory provisions in the handling of appeals from decisions of the Department of the Environment to revoke or modify a consent and for internal consistency. I have considered these Regulations at some length because it seemed to me that they raised important matters. I accept the Department’s view, in response to my initial concerns, that they are intra vires section 2(2) of the European Communities Act 1972 (in spite of the recent decision in Oakley Inc. v Animal Limited and Others EWHC 18 February 2005 about interpreting section 2(2) narrowly) as they deal with a matter related to a Community obligation (section 2(2)(b)): the breadth of the powers in section 2(2) of the European Communities Act is reinforced by the clear statement in section 2(4) of that Act to the effect that Regulations under section 2(2) may contain such provision as might be contained in an Act of Parliament, subject to particular exceptions in Schedule 2 to that Act. I say also that I am satisfied that the provisions of the Regulations to which I refer appear, on consideration, to be compatible with the Convention rights, particularly Article 1 of the First Protocol ECHR: in this case the second paragraph of that Article seems relevant in that these Regulations plainly involve the control of the use of property rather than a deprivation of property, and it seems that the Department can justify the control in the public interest of protecting the environment from harm. (While on the subject of the Convention rights, I refer to my general observation at paragraph 10.)
  2. I raised initial concerns with the Department about regulation 11 (revocation or modification of consent): there is nothing about this in Council Directive 85/337/EEC (as amended), which the Regulations implement as regards certain agricultural projects; rather, the Directive is essentially about the need for proper assessment of the environmental effects of relevant projects (as defined) before consent is granted. (I noted that similar Regulations for England and Wales in S.I. 2003/164 did not seem to contain this power to subsequently revoke or modify a consent.) Coupled with that, it is an offence under regulation 16 to carry on a relevant project except in accordance with a consent.
  3. On further reflection, I suggested to the Department that it should consider amending regulation 11 so as to allow for the determination of an appeal from the Department’s decision to revoke or modify a consent determined under regulation 18 before that revocation or modification of consent took effect. That, it seemed to me, would accord more with provisions in the Planning (Northern Ireland) Order 1991 and the Water (Northern Ireland) Order 1999 on the revocation or modification of various consents and appeals from decisions such as those. I can see that there may well be cases of urgency where the Department considers that it is necessary to take preventive action to revoke or modify a consent in advance of the determination of an appeal, but it seems to me that more of an indication of the reasoning for that decision should be given on the face of regulation 11. Having looked closely at the structure of regulations 11 and 18, it seems to me that the terminology in regulations 11 and 18(1) could usefully be dovetailed so as to fit together more consistently. I report accordingly with the recommendation that the Department should consider amendments to the Regulations to reflect these comments.

THE CARE TRIBUNAL REGULATIONS
(NORTHERN IRELAND) 2005 (S.R. 2005/178)

  1. I draw attention to the Care Tribunal Regulations (Northern Ireland) 2005 (S.I. 20005/178) on the ground that they are defectively drafted, acknowledged by the Department of Health, Social Services and Public Safety.
  2. In regulation 2(1) there are exceptions that refer to regulations 5(4) and (5), whereas there are no such provisions in the Regulations. The Department has explained that the references were from an earlier draft and should have been omitted but were in fact overlooked.
  3. In regulation 2(2) there is a provision which purportedly allows for the delegation of the functions of the Care Tribunal to any member of staff authorised by the tribunal: it seems plain that the actual intention was to allow the Care Tribunal or the Secretary of the Care Tribunal to delegate (administrative rather than judicial or quasi-judicial) functions to another member of the tribunal’s staff; whereas the provision, as drafted, went much too far beyond that.

THE PLANNING (FEES) REGULATIONS
(NORTHERN IRELAND) 2005 (S.R. 2005/222)

  1. I draw attention to the Planning (Fees) Order (Northern Ireland) 2005 (S.R. 2005/222) on the ground that it is defectively drafted in one respect, acknowledged by the Department of the Environment. I understand that the Department will bring forward an amendment when an opportunity next arises (around April 2006). The final part of regulation 4(1) should plainly be full out to the margin so as to indicate that it applies to both sub-paragraphs (a) and (b) of regulation 4(1); whereas, as set out, it appears at first sight to apply only to sub-paragraph (b), which would in turn lead to a contradiction elsewhere in the Regulations. This defect was in fact carried over from earlier Regulations made in 1995. It is a small point in the context of these Regulations, but it usefully illustrates two things: first, the layout of a provision can greatly affect its meaning; and, second, when re-enacting a provision it is beneficial to look out for infelicities or defects in the earlier provision.

THE POLLUTION PREVENTION AND CONTROL (AMENDMENT)
AND CONNECTED PURPOSES REGULATIONS
(NORTHERN IRELAND) 2005 (S.R. 2005/229)

  1. I draw attention to the Pollution Prevention and Control (Amendment) and Connected Purposes Regulations (Northern Ireland) 2005 (S.R. 2005/229) on the ground that these Regulations should, it seems, have been laid before Parliament (subject to annulment in pursuance of a resolution of either House of Parliament). The Department of the Environment fortunately noticed the point (indirectly during the preparation of another set of Regulations under the same power), drew my attention to it and replaced the Regulations with the Pollution Prevention and Control (Amendment) and Connected Purposes (No. 2) Regulations (Northern Ireland) 2005 (S.R. 2005/285), laid before Parliament.
  2. The Regulations are made under Article 4 of the Environment (Northern Ireland) Order 2002. Article 4(7) and (8)(c) of that Order make the Regulations subject to an affirmative procedure before the Assembly because they amend “Northern Ireland legislation”, which, in broad terms, means primary legislation for Northern Ireland other than primary legislation contained in an Act of Parliament extending to Northern Ireland: see the definition of “Northern Ireland legislation” in section 46(3) of the Interpretation Act (Northern Ireland) 1954, as added by paragraph 9(22) of Schedule 1 to the Northern Ireland (Modification of Enactments – No. 1) Order 1999 (S.I. 1999/663)) (definition by reference to the meaning in the Northern Ireland Act 1998: see section 98(1) of that Act); and see also paragraph 3 to the Schedule to the Northern Ireland Act 2000, which has the effect of bringing into that compass Orders in Council made under the 2000 Act during the suspension of the Assembly. During the suspension of the Assembly, the affirmative procedure (before the Assembly) is in effect replaced by a negative procedure before Parliament (that is to say, subject to annulment in pursuance of a resolution of either House of Parliament): see paragraph 7(2) of the Schedule to the 2000 Act.

PHARMACEUTICAL SERVICES AND CHARGES FOR
DRUGS AND APPLIANCES (AMENDMENT) REGULATIONS
(NORTHERN IRELAND) 2005 (S.R. 2005/231)

  1. I draw attention to the Pharmaceutical Services and Charges for Drugs and Appliances (Amendment) Regulations on the grounds that they are drafted in an inconsistent manner and that the principal Regulations relating to pharmaceutical services (that is to say, the Pharmaceutical Services Regulations (Northern Ireland) 1997) are in need of consolidation, both of which matters are acknowledged by the Department of Health, Social Services and Public Safety. The Department has stated that consolidation will follow the phasing in of a new pharmaceutical contract, which is currently being negotiated, over the next 12 to 18 months. The inconsistent drafting is that regulation 2 contains textual amendments of the principal Regulations under the heading “Amendment of the Pharmaceutical Services Regulations (Northern Ireland) 1997”; but so too do regulations 3 to 13 under various headings (for example, regulation 3 is headed “Insertion of Regulation 4A” , regulation 4 is headed “Amendment of regulation 6 of the principal Regulations and regulation 5 is headed “Amendment of regulation 9”). I add that regulation 1(2) contains definitions that are not used elsewhere in the Regulations.

GENERAL OPHTHALMIC SERVICES (AMENDMENT)
REGULATIONS (NORTHERN IRELAND) 2005 (S.R. 2005/292)

  1. I draw attention to the General Ophthalmic Regulations (Northern Ireland) 2005 (S.R. 2005/292) on the grounds that they are defectively drafted in several minor respects and in need of consolidation, both of which matters are acknowledged by the Department of Health, Social Services and Public Safety. The Department acknowledges that the Regulations are in need of consolidation “at the first available opportunity”: the principal Regulations date from 1986 and have been amended at least 19 times. The Department intends use the consolidation to iron out the drafting infelicities, one of which I mention: regulation 2 of the present Regulations introduces a new definition of “optician” into regulation 2 of the principal Regulations so as to mean “optometrist”; but this is in fact unnecessary (and inconsistent with the Health and Personal Social Services (Northern Ireland) 1972 as recently amended by S.I. 2005/848) since an ophthalmic optician (the expression used in the 1972 Order and in the principal Regulations) is one who is registered in the register of optometrists. I report accordingly.

    HAZARDOUS WASTE REGULATIONS
    (NORTHERN IRELAND) 2005 (S.R. 2005/300)

  2. I draw attention to the Hazardous Waste Regulations (Northern Ireland) 2005 (S.R. 2005/300) on the ground that they are defectively drafted in several respects (as regards offences and penalties), acknowledged by the Department of the Environment. Regulation 45 (penalties) refers to an offence under “this regulation”, whereas the reference should be to an offence under regulation 43 (offences) since regulation 45 does not create any offences. Regulation 45(a) wrongly refers to a fine not exceeding level 5 on the statutory scale, whereas, because the offences may be tried either summarily or on indictment, the penalty should be expressed as a fine not exceeding the statutory maximum. Regulation 45 qualifies the penalty as being subject to regulations 43(2) and (3) and 44, but it seems to me that this qualification should be omitted as meaningless and a source of confusion: regulation 43(2) and (3) are defences which, if established, mean that there is no offence in the first place; and regulation 44 creates further statutory duties, breach of which may constitute an offence under regulation 43. Regulation 43(1) refers to failure to comply with a requirement imposed under “Parts 4, 5, 6 and 7”, whereas it should have referred to “Parts 4, 5 and 6 and this Part” (“this Part” being Part 7). These defects are such that the Department should make amending Regulations as soon as possible and I so recommend; otherwise difficulties (unnecessary ones) will arise as and when it comes to enforce the Regulations by way of prosecution. I again emphasise that it is particularly important that provisions creating offences and penalties should be drafted with precision and clarity. I am pleased to report that the Department has accepted all these points and has undertaken to make amending Regulations at the earliest available opportunity.
