Terms of reference

1. I make this Report to the Secretary of State for Northern Ireland under the authority of directions given by the Secretary of State on 13 November 2002 to continue the technical scrutiny during the suspension of the Northern Ireland Assembly under the Northern Ireland Act 2000 (which took effect from 15 October 2002) and to report to the Secretary of State from time to time. My terms of reference expressly refer to statutory rules subject to negative resolution or confirmatory procedure; statutory rules subject to affirmative resolution and statutory rules subject to approval in draft by a resolution of the Assembly are in effect translated by the provisions of the 2000 Act into statutory rules subject to annulment in pursuance of a resolution of either House of Parliament (and as such come under the scrutiny of the Joint Committee on Statutory Instruments at Westminster).

2. Technical scrutiny is a convenient shorthand expression intended to cover the matters set out in Assembly Standing Order 41(6) under which I operate when assisting the Assembly and its Committees in the scrutiny of statutory rules and draft rules laid before it. Standing Order 41(6) is in the following terms—

"(6) In scrutinising an instrument the appropriate Committee [in practice the Examiner of Statutory Rules under delegations from the Committees under Standing Order 41(4)(b) — words added by the Examiner] shall inter alia consider the instrument with a view to determining and reporting whether it requires to be drawn to the attention of the Assembly on any of the following grounds, namely, that:

(a) it imposes a charge on the public revenues or prescribes the amount of any such charge;

(b) it contains provisions requiring any payment to be made to any Northern Ireland department of public body in respect of any approval, authorisation, licence or consent or of any service provided or to be provided by that department or body or prescribes the amount of any such payment;

(c) the parent legislation excludes it from challenge in the courts;

(d) it purports to have retrospective effect where the parent legislation confers no express authority so to provide

(e) there appears to have been an unjustifiable delay in the publication of it or in the laying of it before the Assembly;

(f) there appears to be a doubt whether it is intra vires or it appears to make some unusual or unexpected use of the powers conferred by the parent legislation;

(g) it calls for elucidation;

(h) it appears to have defects in its drafting;

or on any other ground which does not impinge on its merits or the policy behind it.".

Statutory rules covered by this report

3. This report covers statutory rules laid before the Assembly between, for the most part, January 2004 and December 2004 (while the Assembly remains suspended).

The "twenty-one day rule"

4. I have adopted the same approach to the twenty-one day rule as a adopted in my Third Report during suspension. I said there:

"I do not draw attention in this report to any individual statutory rules on the ground that they have breached the so-called " 21-day rule" (that is to say, the rule of practice applied to statutory rules subject to negative resolution whereby the rule-making authority should although at least 21 days between the laying of a statutory rule and its coming into operation). I have taken the view, that that rule is a rule of practice applied by active legislatures in their scrutiny of subordinate legislation and has little or no application during the prolonged suspension of the Assembly. Having said that, it is of course good practice for Departments to adhere the rule as far as possible: for one thing, the 21-day rule will again assume much greater significance when the Assembly is once more fully functioning. I regard this a temporary arrangement and will keep it under review.".

Statutory Rules to which attention is drawn in this report

HOUSING RENEWAL GRANT (REDUCTION OF GRANT) REGULATIONS
(NORTHERN IRELAND) 2004 (S.R. 2004/8)

5. I draw attention to the Housing Renewal Grants (Reduction of Grant) Regulations (Northern Ireland) 2004 (S.R. 2004/8) on the ground that they seem to be defectively drafted in two respects.

6. First, it seemed to that the Recital of Powers should have recited Article 37(2) of the Housing (Northern Ireland) Order 2003 (the 2003 Order) in addition to the other powers recited there since this appeared to the power on which the Department relied in respect of regulation 3. The Department has acknowledged that it should have recited Article 37(2).

7. Second, it seemed to me that that regulation 3 is drafted in such a way as to go wider the power provided for in Article 37(2) of the 2003 Order.

8. Regulation 3 is in the following terms—

"Persons from abroad

3. No grant shall be payable under Part III of the Order if the applicant, or any of the applicants, or any person who is not an applicant but is entitled to make an application and lives or intends to live in the dwelling or, as the case may be, a flat in the building, is a person from abroad within the meaning of regulation 7A of the Hosing Benefits (General ) Regulations (Northern Ireland) 1987.".

I suggested that Article 37(2) of the 2003 Order was confined to prescribing certain applicants as being ineligible for grant aid and queried the words ", or any person who is not an applicant, " (which I have italicised above). The Department explained regulation 3 as follows—

"[R]egulation 3 is intended to prevent the payment of grant to persons from abroad who have no entitlement to housing benefit and to ensure that such persons do not derive any advantage from housing grants The words ", or any person who is not an applicant …" are intended to prevent other persons from applying on behalf of a "person from abroad". This wording reflects provision made for England in regulation 3 of SI 2000/531, for which the relevant power is section 3(3) of the Housing Grants, Construction and Regeneration Act 1996. Article 37(2) of the 2003 Order closely follows section 3(3) of the 1996 Act.".

That explained the purpose behind regulation 3 but it did not convince me that it was fully within the power in Article 37(2) of the 2003 Order. I suggested that regulation 3 might be reformulated to set out the applicants who were not eligible for grants: it could preclude applicants who were themselves persons from abroad; and it could preclude applicants who were somehow applying on the basis that persons from abroad lived or intended to live in the building. The Department has accepted the point in principle, although it would clearly need to consider the wording carefully in the context and structure of the Regulations as a whole: I am not equipped to do that; nor indeed is it my function. My function is to draw attention to the point, as I do.

9. I make the observation in passing the words "Reduction of Grant" in the title are not particularly apt since the Regulations cover much more than reduction of grant. This seems to be a title inherited from earlier Regulations whose purpose has expanded.

INDUSTRIAL TRIBUNALS (CONSTITUTION AND RULES OF PROCEDURE)
REGULATIONS (NORTHERN IRELAND) (S.R. 2004/165)

10. I draw attention to the Industrial Tribunals (Constitution and Rules of Procedure) Regulations (Northern Ireland) 2004 (S.R. 2004/165) on the ground that regulation 4 seems to be doubtful vires acknowledged by the Department for Learning and Employment. I am pleased to report that the Department has since corrected this by revoking regulation 4 in S.R. 2004/317.

11. Regulation 4 (President and Vice-President of industrial tribunals) followed similar Regulations made for England and Wales and for Scotland. The problem for the Northern Ireland Regulations the Northern Ireland Regulations was that they purported to cover similar ground, but with inconsistent provision, to that in Article 82 of the Fair Employment and Equal Treatment (Northern Ireland) Order 1998 (and its predecessor in section 3 of the Fair Employment (Northern Ireland) Act 1989) in providing for the President and Vice-President of Industrial Tribunals and the Fair Employment Tribunal. My view is that the inconsistent provision in subordinate legislation could not have stood alongside the primary legislation since there is no power to amend or modify the primary legislation by means of subordinate legislation. The Department readily accepted the point and, as I indicated, has revoked regulation 4.

SEA FISHING (RESTRICTION ON DAYS AT SEA)
ORDER (NORTHERN IRELAND) 2004 (S.R. 2004/173)

12. I draw attention to Sea Fishing (Restriction on Days at Sea) Order (Northern Ireland) 2004 (S.R. 2004/173) on the ground that Article 3(3) of the Order (as read with Article 4(1)(b)) is drafted in such a way as to give (at the very least) the strong appearance that it is retrospective (even if it would not be construed or applied retrospectively, as the Department of Agriculture and Rural Development contends). The Department acknowledges the point and has indicated that it will try to avoid the problem in any subsequent Orders.

13. Article 3(3) provides for management periods, which are crucial to the restrictions on fishing under the Order, to run from 1 February 2004 (when the regime under the Council Regulation (EC) 2287/2003 came into force); yet the Order did not come into operation until 9 April 2004; so on the face of the Order there was the apparent possibility of an offence being committed under Article 4(1)(b) between 1 February 2004 and 9 April 2004 for breach of the restrictions, even if no court would so hold.

14. By contrast, the corresponding Order for England (S.I. 2004/398) tailored the start of management periods which comprised or included February 2004 to the coming into force of the Order (19 February 2004) — so as to avoid any retrospective element of a kind such as I have mentioned in paragraph 13 : no doubt this was in light of the criticism of the Joint Committee on Statutory Instruments in respect of the previous Order for England (S.I. 2003/229). I referred to the Joint Committee’s criticism in my previous report in relation to the previous Order for Northern Ireland ( S.R. 2003/59).

TRIBUNAL REGULATIONS (NORTHERN IRELAND) (S.R. 2004/165)

15. I draw attention to the Tribunal Regulations (Northern Ireland) 2004 (S.R. 2004/259) on the grounds that the recital of powers is narrowly drawn and that the Regulations are defectively drafted in minor respects as acknowledged by the Department of Health, Social Services and Public Safety.

16. The Regulations are similar to the Regulations for Scotland (S.S.I. 2004/38). The Subordinate Legislation Committee of the Scottish Parliament asked for an explanation of the vires in relation to regulation 29 of the Scottish Regulations (recovery of amounts from practitioners), which is in similar terms to regulation 27 of the Northern Ireland Regulations. The explanation, which satisfied the Subordinate Legislation Committee, referred to the provisions relating to various health service practitioners recited in the recital of powers to the Scottish Regulations. In the light of that, it seems to me that it would have been useful if the Northern Ireland Regulations had similarly recited the relevant provisions in respect of health service practitioners contained in the Health and Personal Social Services (Northern Ireland) Order 1972. The Department of Health, Social Services and Public Safety acknowledges this; in doing so, it maintains that the powers exist, so that regulation 27 is intra vires, which I fully accept.

17. Regulation 2(1) defines "document" in the similarly to the Scottish Regulations, in the following terms—

""document" means a document in writing and includes—

(a) any map, plan, graph or drawing;

(b) any photograph;

(c) any disc, tape, sound track or other device in which sounds or other data (not being visual images) are recorded so as to be capable (with or without the aid of some other equipment) of being reproduced therefrom; and

(d) any film, negative, tape or other device in which one or more visual images are recorded so as to be capable (as foresaid) of being reproduced therefrom;".

That definition, it seems to me, is plainly derived from a definition in the Civil Evidence (Scotland) Act 1988, which is in turn derived from a definition (now repealed) in the Civil Evidence Act 1968 and the Civil Evidence Act (Northern Ireland) 1971. But the draftsmen of both the Scottish Regulations and the Northern Ireland Regulations have, with respect, fallen into error in trying to adapt the definition. The definition starts by defining as document as meaning one thing and then contradicts itself by defining it to include something much wider (a criticism I made in my previous report in relation to a definition of "local authority", which definition has since been corrected accordingly); whereas by contrast the draftsmen of the Civil Evidence Acts above avoided the problem when they started the definition by saying—

""document" includes, in addition to a document in writing,—".

I suggested that the concise and comprehensive formulation from the Civil Evidence Act 1995 and Civil Evidence (Northern Ireland) Order 1997 might suit well (and would cater for technological developments). That is in the following terms—

" "document" means anything in which information of any description is recorded;".

18. The definition of "relevant professional body" includes a reference to "the Royal Pharmaceutical Society of Northern Ireland". This should of course be a reference to "the Pharmaceutical Society of Northern Ireland", a body established by statute.

19. The Department has acknowledged both drafting points and will amend the Regulations at the first opportunity. In passing, I make the comment for future consideration that a title such as Health Services (Tribunal) Regulations (Northern Ireland) would be more indicative of their content since there are clearly many tribunals each with there own code of Regulations. The Department has also noted the point about the title. Interestingly, a title such as I have suggested would be similar to that of the original Regulations made in 1948.

LANDFILL (AMENDMENT) REGULATIONS
(NORTHERN IRELAND) (S.R. 2004/259)

20. I draw attention to the Landfill (Amendment) Regulations (Northern Ireland) 2004 (S.R. 2004/297) on the ground that regulation 9 is defectively drafted, as acknowledged by the Department of the Environment.

21. Regulation 9 contains various amendments of Schedule 5 to the Landfill Regulations (Northern Ireland) 2003 (S.R. 2003/496), which provision itself amends the Pollution Prevention and Control Regulations (Northern Ireland) 2003 and the Waste Management Licensing Regulations (Northern Ireland) 2003. The Department accepts that most of the amendments in regulation 9 (that is to say, those contained in regulation 9(2), (4), (5), (6) and (7)) should have been framed as appropriate direct amendments of the Pollution Prevention and Control Regulations and the Waste Management Licensing Regulations. Suffice it to say that Department intends to revisit both of those sets of Regulations to make appropriate amendments to implement what it intended (but did not achieve exactly) in regulation 9.

TRANSMISSIBLE SPONGIFORM ENCEPHALOPATHY (AMENDMENT)
REGULATIONS (NORTHERN IRELAND) (S.R. 2004/388)

22. I draw attention to the Transmissible Spongiform Encephalopathy (Amendment) Regulations (Northern Ireland) 2004 (S.R. 2004/388) on the ground that they are defectively drafted in one respect, acknowledged by the Department of Agriculture and Rural Development.

23. New Schedule 6A of the Transmissible Spongiform Encephalopathy Regulations (Northern Ireland) 2002 (as inserted by regulation 5) contains a number of new offences (in paragraphs 8, 10, 11 and 12). But no penalties are prescribed in respect of those offences because of the wording in regulation 99(1) and (2) of the 2002 Regulations, which provisions run as follows—

"Offences and penalties

99.—(1) If a person contravenes or fails to comply with any prohibition or requirement imposed by or under these Regulations and the contravention or failure is not made an offence by any other provision of these Regulations, he shall be guilty of an offence.

(2) A person guilty of an offence under this regulation shall be liable—

(a) on summary conviction, to a fine not exceeding the statutory maximum or to imprisonment for a term not exceeding three months or to both; or

(b) on conviction on indictment, to a fine or to imprisonment for a term not exceeding two years or to both.".

(emphasis added)

The italicised words have the effect of excluding the offences under new Schedule 6A from the provision for penalties in regulation 99(2). I mention in passing that the same problem seems to apply to the Regulations for England but not those for Scotland (simply because the general provision in respect of offences and penalties in the Scottish Regulations is not drafted with the same restriction).

THE EUROPEAN PUBLIC LIMITED-LIABILITY COMPANY
REGULATIONS (NORTHERN IRELAND) (S.R. 2004/417)

24. I draw attention to the European Public Limited-Liability Company Regulations (Northern Ireland) 2004 (S.R. 2004/417) on the ground that they seem to be defectively drafted in one minor respect (regulation 36).

25. I asked the Departments for an explanation of regulation 36 (exclusivity of remedy), which is in the following terms—

"Exclusivity of remedy

36. The remedy for infringement of the rights conferred by these Regulations is by way of complaint to Industrial Court in accordance with this Part and not otherwise.".

That did not seem to be what the actual intention was because it seemed to me that there were other plainly other remedies available under Part III (not least complaints to an industrial tribunal under Chapter 8 of Part III). There were also applications (as distinct from complaints) to the Industrial Court under Part III. So it seemed to me that the intention might have been achieved in a provision along the following lines—

"Exclusivity of remedy

36. Where this Part provides for a remedy for infringement of any right by way of application or complaint to the Industrial Court (and provides for no other remedy), no other remedy is available for infringement of that right.".

The Departments, in response, accept that regulation 36 as it stands could be improved but "consider that a court would have no difficulty in construing it to cover all rights enforceable by application or complaint to the Industrial Court and to exclude rights enforceable by complaint to an industrial tribunal". I accept there may be some weight in the Departments’ assessment, but clearly it is better that such a provision (expressly seeking to restrict remedies that might otherwise be available) should do exactly what it says on its face; and, accordingly, I invite the Departments to amend the provision as and when an opportunity arises: I commend my suggestion to the Departments for consideration, with the usual caveat that is of course for the Departments to settle the draft in accordance with the precise intent sought to be achieved; for I am not equipped to do that and nor indeed is it my function.

26. Having criticised one fairly minor aspect of the Regulations that does not in any way affect their overall working or workability, I commend the Departments for the obvious care they have taken in making the Regulations (which make provision for the effective application of Council Regulation 2157/2001/EC and for the implementation of Council Directive 2001/86/EC).

THE MISCELLANEOUS FOOD ADDITIVES (AMENDMENT)
REGULATIONS (NORTHERN IRELAND) 2004 (S.R. 2004/439)


27. I draw attention to the Miscellaneous Food Additives (Amendment) Regulations (Northern Ireland) 2004 (S.R. 2004/439) on the ground that they are defectively drafted in one respect, which defect also is also of doubtful vires in that it seems to contain a retrospective element to an offence expressed in relation to proceedings for a defence to criminal proceedings.

28. The Regulations came into operation on 5 November 2004: they probably should have been brought into operation on 1 November 2004 (as were the similar Regulations for England and for Scotland) so as to implement the relevant Directive (that is to say, Commission Directive 2003/95/EC) on time; but, as it happened, the Regulations were made to come into operation on 5 November 2004, and the Food Standards Agency is stuck with that date, as it were. Regulation 4 inserts a new provision in regulation 11 of the principal Regulations (regulation 11E(a)), which provision contains a defence to criminal proceedings; but the problem is that the defence refers to the putting on the marking or the labelling of the food or food additive concerned before 1 November 2004, whereas the logic of the defence seems to be that the putting on the market or the labelling should take place before the commencement of the Regulations, that is to say, 5 November 2004. I raised this point with the Food Standards Agency and, in response, the Food Standards Agency has indicated that an amendment to correct this will be drafted as quickly as possible.

MOTOR CYCLES ETC. (SINGLE VEHICLE APPROVAL) (FEES)
REGULATIONS (NORTHERN IRELAND) 2004 (S.R. 2004/486)

29. I draw attention to the Motor Cycles Etc. (Single Vehicle Approval) (Fees) Regulations (Northern Ireland) 2004 (S.R. 2004/486) on the ground that they are defectively drafted in one respect, acknowledged by the Department of the Environment. The point is simply that the Regulations contain extraneous definitions: regulation 2(1) defines the expressions "same model" and "Schedule 1 vehicle", whereas these expressions are not used elsewhere in the Regulations and therefore should not have been included. The definitions were, it seems, hangovers from an earlier draft in which those terms were used. The Department intends to remove the extraneous definitions at the next opportunity (towards the end of 2005), which seems a satisfactory course.

FARM NUTRIENT MANAGEMENT SCHEME (NORTHERN IRELAND)
2004 (S.R. 2004/498)

30. I draw attention to the Farm Nutrient Management Scheme (Northern Ireland) 2004 (S.R. 2004/498) on the ground that it has been purportedly made according to the wrong statutory formula so that it appears to be of doubtful vires, acknowledged by the Department of Agriculture and Rural Development. The point is simply that the Scheme is made under Article 16 of the Agriculture and Fisheries (Financial Assistance) Order (Northern Ireland) 1987, which provision requires the approval of the Department of Finance and Personnel to the making of the Scheme, whereas the Scheme is puportedly framed in terms of the consent of the Department of Finance and Personnel. The Department intends to revoke and re-enact the Scheme.

THE FEEDING STUFFS (SAFETY REQUIREMENTS FOR FEED FOR
FOOD-PRODUCING ANIMALS) REGULATIONS
(NORTHERN IRELAND) 2004 (S.R. 2004/506)

31. I draw attention to the Feeding Stuffs (Safety Requirements for Feed for Food-Producing Animals) Regulations (Northern Ireland) 2004 (S.R. 2004/506) on the ground that they are defectively drafted in one respect, acknowledged by the Food Standards Agency. In regulation 3(3) it is plain that the words ", within its area," in relation to enforcement by the Department of Agriculture and Rural Development have been included by mistake: they seem to have crept in from the similarly worded regulation 3(3) of the Regulations for Great Britain (S.I. 2004/3254) where the words are appropriately used in the context of local enforcement authorities. The Food Standards Agency intends to remove the defect when the Regulations are next amended, which seems satisfactory: the defect does not in any way affect the workability of the Regulations.

SALMONELLA IN LAYING FLOCKS (SURVEY POWERS)
REGULATIONS (NORTHERN IRELAND) 2004 (S.R. 2004/525)

32. I draw attention to the Salmonella in Laying Flocks (Survey Powers) Regulations (Northern Ireland) 2004 (S.R. 2004/525) on the ground that they contain drafting defects similar to those identified by the Joint Committee (of both House of the Parliament of the United Kingdom) on Statutory Instruments in relation to the corresponding Regulations for England (S.I. 2004/2885): see the Third Report of the Joint Committee on Statutory Instruments Session 2004 – 2005, 14 December 2004. The Regulations for England contain an extraneous definition of "laying hen": the definition is not required because it is not used elsewhere in the Regulations; and the Regulations Northern Ireland curiously contain the same definition (again unnecessary, it seems to me) for the expression "laying flock" (whereas a "flock" must surely comprise a number of hens). Second, in both the Regulations for England and for Northern Ireland, regulation 7(b) is drafted so as to make non-compliance with regulation 3(2)(c) and 5(1)(e) an offence, whereas non-compliance with similar provisions (regulation 3(2)(a) and 5(1)(a) is not an offence. The Department for Environment, Food and Rural Affairs acknowledged the defects in a memorandum to the Joint Committee dated 6 December 2004, undertaking to make replacement Regulations "forthwith. The Department of Agriculture and Development, which was not aware of the Joint Committee’s Report on the Regulations for England (available only days before the Department made the Regulations for Northern Ireland), has undertaken to follow with replacement Regulations.
