ACTS OF THE NORTHERN IRELAND ASSEMBLY The Northern Ireland Assembly (1998-2003) enacted 36 Acts. This section of the CD-Rom lists those Acts together with a brief description of their purpose and the originating authority. Financial Assistance for Political Parties Act (Northern Ireland) 2000 c. 1 Provides for the making of payments to political parties for the purpose
of assisting members of the Northern Ireland Assembly who are connected
with such parties to perform their Assembly duties. (10 Feb 2000) Appropriation Act (Northern Ireland) 2000 c. 2 Authorises the issue out of the Consolidated Fund of certain sums for
the service of the year ending on 31st March 2001; appropriates those
sums for specified purposes and authorises other sums to be applied
as appropriations in aid for those purposes; authorises the Department
of Finance and Personnel to borrow on the credit of the appropriated
sums; and repeals certain Appropriation Orders. (25 Jul 2000) Allowances to Members of the Assembly Act (Northern Ireland) 2000 c. 3 Makes provision for the payment of allowances to or in respect of persons
who have been members of the Northern Ireland Assembly or holders of
offices mentioned in section 47(3)(a) of the Northern Ireland Act 1998.
(25 Jul 2000) Child Support, Pensions and Social Security Act (Northern Ireland) 2000 c. 4 Amends the law relating to child support; amends the law relating to
occupational and personal pensions; amends the law relating to social
security benefits and social security administration; amends Part III
of the Family Law Reform (Northern Ireland) Order 1977 and Part V of
the Matrimonial and Family Proceedings (Northern Ireland) Order 1989;
and for connected purposes. (20 Nov 2000) Weights and Measures (Amendment) Act (Northern Ireland) 2000 c. 5 Amends the Weights and Measures (Northern Ireland) Order 1981 to allow
self-verification of weighing or measuring equipment, e.g. scales, petrol
pumps; testing by official EEA testers and pre-test stamping. (20
Dec 2000) Top Dogs (Amendment) Act (Northern Ireland) 2001 c. 1 Makes provision regarding the destruction of dogs under the Dogs (Northern
Ireland) Order 1983. (29 Jan 2001) Planning (Compensation, etc.) Act (Northern Ireland) 2001 c. 2 Abolishes the right to compensation in respect of certain planning
decisions; and amends Article 121(1)(c)(iv) of the Planning (Northern
Ireland) Order 1991. (20 Mar 2001) Health and Personal Social Services Act (Northern Ireland) c. 3 Establishes a Northern Ireland Social Care Council and makes provision
for the registration, regulation and training of social care workers;
simplifies the system for recovery from insurance companies of health
service costs in connection with the treatment of road traffic casualties
in health services hospitals; amends the law about the health and personal
social services; confers power to regulate the profession of pharmaceutical
chemist; and for connected purposes. (20 Mar 2001) Fisheries (Amendment) Act (Northern Ireland) c. 4 Amends the Fisheries Act (Northern Ireland) 1966 and allows DARD to
manage, protect and regulate fisheries in or on the foreshore around
the coast of Northern Ireland; provides for regulation of fisheries
for environmental reasons; permits trade in farmed salmon roe; enables
Fisheries Conservancy Board to control removal of materials from rivers,
to reinstate waters affected by pollution and recover costs from the
convicted polluters; extends Board's bye-law making powers for management
and provision of fisheries. (20 Mar 2001) Ground Rents Act (Northern Ireland) 2001 c. 5 Makes provision for the redemption of certain ground rents and other
periodic payments. (20 Mar 2001) Government Resources and Accounts Act (Northern Ireland) 2001 c. 6 Makes provision about government resources and accounts; and for connected
purposes. Resource Accounting and Budgeting (RAB) directly affects all
Government departments (including Executive agencies) and indirectly
affects non-departmental public bodies and the public sector generally.
It enables departmental estimates and accounts to be prepared on a resource
(accruals accounting) basis rather than a cash basis. (22 Mar 2001) Budget Act (Northern Ireland) 2001 c. 7 Authorises the issue out of the Consolidated Fund of certain sums for
the service of the years ending 31st March 2001 and 2002;
appropriates those sums for specified purposes and amends certain appropriations
in aid for the year ending 31st 2001; authorises the Department
of Finance and Personnel to borrow on the credit of the appropriated
sums; and authorises the use for the public service of certain resources
for the year ending 31st March 2002 (22 Mar 2001) Street Trading Act (Northern Ireland) 2001 c. 8 Makes provision for the regulation by district councils of street trading
in their districts. (5 Apr 2001) Electronic Communications Act (Northern Ireland) 2001 c. 9 Makes provision to facilitate the use of electronic communications
and electronic data storage. (5 Apr 2001) Defective Premises (Landlord's Liability) Act (Northern Ireland) 2001 c. 10 Amends the law as to the liability of landlords for injury or damage
caused to persons through defects in the state of premises let under
certain tenancies. (2 Jul 2001) Adoption (Intercountry Aspects) Act (Northern Ireland) 2001 c. 11 Makes provision for giving effect to the Convention on Protection of
Children and Co-operation in respect of Intercountry Adoption concluded
at the Hague on 29th May 1993; makes further provision in relation to
adoptions with an international element; and for connected purposes.
(2 Jul 2001) Family Law Act (Northern Ireland) 2001 c. 12 Makes a further provision for the acquisition of parental responsibility
under Article 7 of the Children (Northern Ireland) Order 1995; and provides
for certain presumptions of parentage and for tests to determine parentage.
Unmarried fathers who jointly register the birth of the child with the
mother will now be conferred with parental responsibility - a legal
relationship which didn't previously exist. (17Jul 2001) Product Liability (Amendment) Act (Northern Ireland) 2001 c. 13 Amends Part II of the Consumer Protection (Northern Ireland) Order
1987 to include 'faults' in agricultural produce - game, fruit, vegetables,
etc, in line with EU legislation. (20 Jul 2001) Trustee Act (Northern Ireland) 2001 c. 14 Amends the law relating to trustees and persons having the investment
powers of trustees; and for connected purposes. Widens the powers of
investment to replace present statutory powers. This general power is
complimented by new powers to appoint agents, nominees and custodians,
to purchase land, to insure trust property and to pay professional trustees.
These new powers are overseen by a statutory duty of care. (20 Jul
2001) Department for Employment and Learning Act (Northern Ireland) 2001 c. 15 Renames the Department of Higher and Further Education, Training and
Employment as the Department for Employment and Learning. (20 Jul
2001) Budget (No. 2) Act (Northern Ireland) 2001 c. 16 Authorises the issue out of the Consolidated Fund of certain sums for
the service of the year ending 31st March 2002; appropriates those sums
for specified purposes; authorises the Department of Finance and Personnel
to borrow on the credit of the appropriated sums; authorises the use
for the public service of certain resources (including accruing resources)
for the year ending 31st March 2002; and repeals certain spent enactments.
(20 Jul 2001) Social Security Fraud Act (Northern Ireland) 2001 c. 17 Makes provision, for the purposes of the law relating to social security,
about the obtaining and disclosure of information; and makes provision
for restricting the payment of social security benefits in the case
of persons convicted of offences relating to such benefits and about
the institution of proceedings for such offences; and for connected
purposes. Gives additional powers to obtain information from specified
private and public sector organisations to tackle benefit fraud and
error; and to reduce or withdraw specified benefits where an offender
is convicted twice of a benefit offence within a 3 year period. (15
Nov 2001) Top Industrial Development Act (Northern Ireland) 2002 c. 1 Establishes Invest Northern Ireland to exercise certain existing functions
in relation to industrial development; dissolves the Industrial Development
Board for Northern Ireland, the Local Enterprise Development Unit and
the Industrial Research and Technology Unit; abolishes certain functions
of the Northern Ireland Tourist Board; amends the Industrial Development
(Northern Ireland) Order 1982; and for related purposes. Establishes
a single economic development agency (INI) as a non-departmental public
body. Transfers existing powers in the Industrial Development (NI) Order
1982 to Invest NI therefore allowing it to exercise broadly the functions
within the current remit of IDB, LEDU, IRTU, Business Support division
of DETI and business support activities of NITB, and transfers current
assets and liabilities of existing bodies. (7 Feb 2002) Game Preservation (Amendment) Act (Northern Ireland) 2002 c. 2 Amends the Game Preservation Act (Northern Ireland 1928; amends the
law relating to the killing, taking or destroying of rabbits and hares;
and extends partridge shooting season to include September each year.
(13 Feb 2002) Budget Act (Northern Ireland) 2002 c. 3 Authorises the issue out of the Consolidated Fund of certain sums for
the service of the years ending 31st March 2002 and 2003; appropriates
those sums for specified purposes; authorises the Department of Finance
and Personnel to borrow on the credit of the appropriated sums; authorises
the use for the public service of certain resources for the years ending
31st March 2002 and 2003; and evises the limits on the use of certain
accruing resources in the year ending 31st March 2002. (20 Mar 2002) Local Government (Best Value) Act (Northern Ireland) 2002 c. 4 Makes provisions placing on district councils a general duty to make
arrangements for continuous improvement in the way in which their functions
are exercised; and for connected purposes. (26 Mar 2002) Personal Social Services (Preserved Rights) Act (Northern Ireland) 2002 c. 5 Makes provision in relation to persons in residential accommodation
with preserved rights under the Income Support (General) Regulations
(Northern Ireland) 1987; and for connected purposes. (26 Mar 2002) Carers and Direct Payments Act (Northern Ireland) 2002 c. 6 Makes provision about the assessment of carers' needs; provides for
services to help carers; provides for the making of direct payments
to persons in lieu of the provision of personal social services or carers'
services; and for connected purposes. (2 May 2002) Budget (No. 2) Act (Northern Ireland) 2002 c. 7 Authorises the issue out of the Consolidated Fund of certain sums for
the service of the year ending 31st March 2003; appropriates those sums
for specified purposes; authorises the Department of Finance and Personnel
to borrow on the credit of the appropriated sums; authorises the use
for the public service of certain resources (including accruing resources)
for the year ending 31st March 2003; and repeals certain spent enactments.
(12 Aug 2002) Railway Safety Act (Northern Ireland) 2002 c. 8 Makes provision with respect to the safety of railways. (13 Aug
2002) Health and Personal Social Services Act (Northern Ireland) 2002 c. 9 Amends the Health and Personal Social Services (Northern Ireland) Order
1972 in relation to charges for nursing care in residential accommodation;
provides for public payments for nursing care for people resiedent in
nursing homes; provides for the establishment and functions of the Northern
Ireland Practice and Education Council for Nursing and Midwifery; and
for connected purposes. (4 Oct 2002) Social Security Act (Northern Ireland) 2002 c. 10 Amends the law relating to statutory maternity pay; amends the law
relating to maternity allowance; makes provision for work-focused interviews
for partners of benefit claimants; makes provision about the use of
information for, or relating to, employment and training; amends the
Deregulation and Contracting Out (Northern Ireland) Order 1996; and
for connected purposes. (17 Oct 2002) Children (Leaving Care) Act (Northern Ireland) 2002 c. 11 Makes provision about children and young persons who are being, or
have been, looked after by an authority within the meaning of the Children
(Northern Ireland) Order 1995; to replace Article 35 of that Order;
and for connected purposes. (22 Nov 2002) Limited Liability Partnerships Act (Northern Ireland) 2002 c. 12 Makes provision for limited liability partnerships. (22 Nov 2002) Open-Ended Investment Companies Act (Northern Ireland) 2002 c. 13 Makes provision for facilitating the carrying on of collective investment
by means of open-ended investment companies and for regulating such
companies. (22 Nov 2002) State Pension Credit Act (Northern Ireland) 2002 c. 14 Makes provision for and in connection with a new social security benefit
called state pension credit; and amends section 43(1) of the Pension
